1.1. Referrer: An existing customer of Hai Ha Money Transfer & Foreign Exchange who holds a valid registered account, has at least one completed (successful) online money transfer transaction, and shares a unique Referral Link with others to invite them to be their Referee.

1.2. Referee: A person who has not successfully registered for an online account with Hai Ha Money Transfer & Foreign Exchange before being referred and registers via the Referrer’s link. A Referee can be an existing in-store customer as long as they have not successfully registered for an online account before receiving the Referrer’s link.

1.3. Referral link (“Referrer’s link”): A trackable link unique to each Referrer to invite the Referee for the referral rewards. The Referrer can get this link by logging in their online account and clicking the “Share” button on the ”Referral” page in their “Profile.’’

1.4. Rewards: The benefits offered to both the Referrers and Referees for a successful referral. The reward details can be found on this Referral Program’s landing page and can be changed from time to time, as demonstrated in clause 4.1.

1.5. Successful referral: A referral which satisfies both of the following two criteria:

1.5.1. The Referee registers an online account using the Referrer’s link; and

1.5.2. The Referee’s online money transfer transaction is completed (the funds have been delivered to the receiver, and the receiver must not be the Referrer).

1.6. Opt-out referrals:

1.6.1. After clicking “Share,” if the Referrer has no Referees (including pending/successful) for 180 consecutive days, the Referrer will be opted out of the Referral Program and have their link invalidated (unable to receive any rewards if a new Referee registers using their link). They can rejoin anytime to get a new link.

1.6.2. After registering and receiving the online account activation email, the Referee must complete a new online transaction within 180 consecutive days. Otherwise, they will be opted out of the Referral Program and lose their reward.

2.1. You shall use the Referral Program in good faith and for lawful, moral and ethical purposes only. You must not:

2.1.1. create more than one account to invite yourself (duplicated Referrer) or to register using different Referral links from different Referrers (duplicated Referee);

2.1.2. invite those who already have an online account at Hai Ha Money Transfer & Foreign Exchange;

2.1.3. invite persons who are:

2.1.3.1. under the age of 18;

2.1.3.2. fictitious or fraudulent;

2.1.4. impersonate or misrepresent another person’s identity;

2.1.5. exploit automated systems, scripts, or macros to manipulate your participation in the Referral Program; or

2.1.6. use and communicate the Referral Program:

2.1.6.1. for commercial or business purposes;

2.1.6.2. with strangers (unless they let you know, verbally or in writing, that they want it),

2.1.6.3. via bulk distribution, or in any manner that may constitute unsolicited communication or spam under applicable law;

2.1.6.4. in misleading, deceptive, unlawful, or abusive conduct; or

2.1.6.5. in any way that may damage Hai Ha Money Transfer & Foreign Exchange’s interests, brand, goodwill or reputation;

2.2. If we suspect any T&Cs breach and violations or consider your use of the Referral Program is inappropriate, including but not limited to the prohibited uses listed in clause 2.1, we have our sole and absolute discretion to suspend or terminate your participation, your online account,  and/or all unused Rewards and Reward level associated with your participation in our Referral Program. This action takes immediate effect without further compensation.

3.1. By participating in our Referral Program, you agree to our Privacy Policy and all relevant data protection laws and industry codes. Your email address will be provided to our software service provider for the purpose of tracking your participation and rewards in the Referral Program. 

3.2. If you are a Referee, your last name and the initials of your first name will be visible to your Referrer for Reward tracking purposes. 

4.1. We have the full right to modify, add to, substitute, pause or terminate the Referral Program at any time without notice and with or without cause.

4.2. If the Referral Program’s rules, rewards, or T&Cs are amended:

4.2.1 The revised content after the amendments will be republished on this Referral Program’s landing page.

4.2.2. The amendments are effective immediately upon being republished or as specifically stated otherwise. No express notification about the amendments is required.

4.2.3. Your participation and/or continued use of the Referral Program after the amendments constitutes your consent to the new rules and/or T&Cs.

4.3. If the Referral Program is terminated, all unused Rewards are forfeited. All Rewards are provided as is, and no substitutions are allowed.

5.1. Hai Ha Money Transfer & Foreign Exchange shall not be liable for any use of the Referral Program which does not comply with our T&Cs.

5.2. To the maximum extent permitted by law, and notwithstanding any other provision in our Referral Program, we hold no liability to you in contract, tort (including tort of negligence), breach of statutory duty, equity, misrepresentation, restitution or otherwise for any arising indirect, incidental, consequential, special, punitive or exemplary losses, even if both you and us knew such damages were possible. You acknowledge that this limitation of liability is fair and reasonable.

5.3. Your participation in our Referral Program establishes no employer/employee, principal/agent, joint venture, or partnership relationship between you and us. You are solely responsible for your actions.

5.4. You will indemnify us from all claims, losses, damages, costs, and expenses, including legal fees, arising from your breach of our T&Cs, fraud and scam, or any misconduct (including negligence) that damages our interests, brand, goodwill or reputation.

6.1. The Referral Program is governed by the laws of Australia and all states.

6.2. As a condition of participating in this Referral Program, the participant agrees that any and all disputes that cannot be resolved between the parties and causes of action arising out of or connected with this Referral Program shall be resolved individually, without resorting to any form of class action, exclusively before a court located in NSW having jurisdiction.

6.3. In any such dispute, under no circumstances shall the participant be permitted to obtain rewards for, and hereby waives all rights to, indirect, incidental, consequential, special, punitive or exemplary losses, including reasonable attorney’s fees, other than the participant’s actual out-of-pocket expenses. Participant further waives all rights to have damages multiplied or increased.

7.1. Our T&Cs’ original language is English, before being translated into any other language.

7.2. In the case of discrepancies between the English version of our T&Cs and any translations, the English language version will take precedence. Any notices or other documents shall also adhere to this rule.
